These Terms of Service apply to the use of the fitness app "StateByStep"
(hereinafter "App" or "Service"), operated by Provimedia GmbH, Weidenweg 12,
74321 Bietigheim-Bissingen, Germany (hereinafter "Provider", "we" or "us").
By registering an account, you accept these Terms of Service and our
Privacy Policy.
Deviating terms of the user are not recognized unless the provider expressly agrees
to their validity in writing.
2. Contract Formation
The usage contract is concluded by registering an account. By registering, you confirm:
You are at least 16 years old
You have read and accepted the Terms of Service and Privacy Policy
The information you provided is correct
Beta Phase: StateByStep is currently in a closed beta phase.
Registration is only possible with a valid invitation code. The provider reserves
the right to end or modify the beta phase at any time.
3. Service Description
StateByStep is a social fitness app that offers the following features:
Fitness Tracking: Recording workouts, training sessions and physical activity
Nutrition Tracking: Logging meals and nutritional values, optionally with AI support
Progress Documentation: Storage of body data and progress photos
Social Features: Connection with other users, groups, challenges
Coach Features: Optional support by certified coaches
The provider is entitled to expand, restrict or change the scope of features at any time.
Significant restrictions will be communicated to users in advance.
Availability: We strive for high availability of the app but cannot
guarantee it. Maintenance and technical issues may lead to temporary outages.
4. Account and Credentials
4.1 Account Creation
A personal account is required to use the app. Only one account per person is permitted.
The use of pseudonyms as usernames is allowed.
4.2 Credentials
You are obligated to keep your credentials secret and protect them from third-party
access. If you suspect misuse of your account, please inform us immediately.
4.3 Account Security
We strongly recommend:
Using a strong, unique password
Enabling two-factor authentication (2FA)
Regularly reviewing account activities
5. Usage Rules (Community Guidelines)
When using StateByStep, you agree to follow these rules:
5.1 Permitted:
Sharing fitness progress and achievements
Motivating and supporting other users
Constructive exchange about training and nutrition
Creating groups for shared fitness goals
5.2 Prohibited:
Illegal Content: Content that violates applicable law
Harassment: Insults, bullying, stalking or threatening other users
Hate Speech: Discrimination based on origin, gender, religion, sexual orientation or disability
Explicit Content: Pornographic or excessively violent content
Spam: Unsolicited advertising, chain letters or mass messages
Dangerous Content: Promotion of eating disorders, extreme diets or health-damaging behavior
Fraud: Misleading information, fake profiles or identity theft
Manipulation: Automated access, bots or scraping
5.3 Consequences for Violations
In case of violations, the provider may:
Remove content
Issue warnings
Temporarily suspend the account
Permanently delete the account
The decision is at the provider's discretion. For serious violations, we reserve
the right to take legal action.
6. User Content
6.1 Ownership
You retain all rights to your content (texts, photos, etc.). However, by uploading,
you grant the provider a non-exclusive, worldwide, royalty-free license to display
and process this content within the app.
6.2 Responsibility
You are responsible for all content you upload. You warrant that:
You have all necessary rights to the content
The content does not infringe third-party rights
The content does not violate these Terms of Service
6.3 Reporting Violations
If you discover content that violates our rules, please report it via the report
function in the app or by email to
info@provimedia.de.
7. Health Disclaimer
Important Notice: StateByStep is not a medical application
and does not replace the advice of a doctor, nutritionist or qualified fitness trainer.
Please note:
Consult a doctor before starting a new training program, especially if you have pre-existing conditions
AI-based nutritional analyses are estimates and may be inaccurate
Listen to your body and don't overexert yourself
Seek medical help for health complaints
The provider assumes no liability for health damage resulting from improper use of
the app or ignoring medical advice.
8. Liability
8.1 Limitation of Liability
The provider is fully liable for damages resulting from injury to life, body or health,
as well as for intent and gross negligence.
For slight negligence, the provider is only liable for breach of essential contractual
obligations (cardinal obligations) and limited to the typical, foreseeable damage.
8.2 Availability
The provider is not liable for the constant availability of the app. Technical
disruptions, maintenance work and force majeure may lead to outages.
8.3 User Content
The provider is not liable for content created by users. Each user is responsible
for their own content.
8.4 External Links
The app may contain links to external websites. We assume no liability for their content.
9. Termination
9.1 Termination by User
You can terminate your account at any time without giving reasons:
In the app: Settings → Danger Zone → Delete Account
After termination, your data will be irrevocably deleted within 30 days.
9.2 Termination by Provider
The provider can terminate the usage contract:
With 30 days' notice without giving reasons
Without notice for serious violations of these Terms of Service
Upon discontinuation of the service (with reasonable advance notice)
10. Changes to Terms
The provider reserves the right to change these Terms of Service:
In case of changes in the legal situation
In case of changes to the scope of features
To close regulatory gaps
You will be informed of significant changes by email or in-app notification. If you
do not object within 30 days, the changed terms are deemed accepted.
In case of objection, you can terminate your account.
11. Final Provisions
11.1 Applicable Law
The law of the Federal Republic of Germany applies, excluding the UN Sales Convention.
For consumers, the mandatory consumer protection provisions of the state in which
the consumer has their habitual residence also apply.
11.2 Jurisdiction
For disputes with entrepreneurs, the place of jurisdiction is Besigheim, Germany.
For consumers, the statutory place of jurisdiction applies.
11.3 Severability Clause
Should individual provisions of these Terms of Service be or become invalid, the
validity of the remaining provisions remains unaffected.
